General Terms & Conditions for all FirstBank SMS Promotions

Definitions
"You" means the person or entity who signs up to participate in, or uses in any way, any or all of FirstBank’s SMS Promotions and Alerts. "We," "our," "us" and "provider" refer to FirstBank. "Applications" and/or "Content" refer to any file, device or software that can be downloaded by you to either a computer or a wireless device such as a handset or a personal digital assistant. "Service" means any of FirstBank’s Promotions and Alerts, including FirstBank Account Alerts and FirstBank’s App Download.

Acceptance by You
By using the Service provided by us, you have agreed to be bound by the terms and conditions herein ("Agreement").

What are the Participating Carriers?
Content is not available on all carriers: The Service is available on Alltel, AT&T, Boost, Dobson, Nextel, Sprint, T-Mobile™, Verizon Wireless, U.S. Cellular™, Metro PCS, Cricket and Virgin Mobile. Product is not compatible with all cell phone models. Provider is not responsible for any delays upon sending or receiving text message.

What are FirstBank Alerts?
FirstBank Promos & Alerts are SMS messages that contain promotions for FirstBank.

How do I sign up for FirstBank Alerts
Sign up for Alerts by logging into FirstBank’s Online Banking and navigating to the ‘Settings and Alerts’ page.

Is it free?
Although FirstBank Alerts are free, message and data rates may apply. Depending on your text plan, you may be charged by your carrier. By enrolling in the Service, you certify that you are over 18 years of age and (A) you are the account holder or (B) you have the account holder's permission to do so.

What if I don’t want to receive any more promotional messages or alerts?
To STOP receiving Alerts, simply text STOP to 67247, email banking@efirstbank.com or call 800-964-3444.

What if I want to opt back in?
You can start receiving FirstBank Alerts again by following the steps outlined in the above section: “How do I sign up for FirstBank Alerts?”

App Download
Bank anywhere using your mobile device, 24 hours a day, 7 days a week. You can access the mobile banking app by downloading it from your app store. You can then log in using your existing username, password, and security questions for Online Banking. Text 'App' to 67247 and you will receive a link that directs you to our app in your app store.

Video Banking Terms and Conditions

In this agreement, the words “Customer”, “you”, “your”, and “yours” refer to the customers of FirstBank who have electronically agreed to be bound by this agreement. These terms also apply, in context, to all entities or persons who are affiliates, subsidiaries, or other related organizations or individuals who have been properly authorized to use any of the services under the Online Banking programs (the “Programs”). The word “FirstBank” means any banking subsidiary of FirstBank Holding Company, Inc. The words “we”, “us”, and “our” mean the FirstBank where you maintain your deposit accounts. You have requested us to provide online remote assistance (the “service”) in connection with our Programs. By clicking the link to activate the service, you represent and certify to us that you are an authorized user of Online Banking. You further represent that you are authorized to engage and direct us to provide the service to you, and that you are also authorized to agree to the terms and conditions under which we will render the service.

This agreement is entered into as of the date of its electronic acceptance (the "Effective Date") by you, and your use of the service will bind you to the terms of this agreement. We reserve the right to amend this agreement at any time by modifying the agreement online. All changes will be effective immediately. The most current version of this agreement can be reviewed and downloaded by clicking on the link on the initial program screen entitled "Terms of Online Remote Service." We offer this service only on a temporary basis and reserve the right to suspend or terminate the service and this agreement at any time.

Description of Service

You may access and use the service to enable us to provide assistance by viewing screens for questions and operational problems relating to the Programs. This is accomplished during a live support session in which you must be in attendance. As part of the live session, you will download a self-installing plug-in software that enables us to view the desktop of your computer. We will not be able to share control of your mouse and keyboard or any other function on your computer. During the live session, you can end the screen sharing ability at any time.

You acknowledge and agree that the service is provided to you without any guaranties or promises on our part, and that all risks and liability from any use of the service will be borne by you. We also will not be liable for any other damages or losses that may result from your use of the service including, without limitation, loss of income, loss of opportunity, lost profits, costs of recovery or any other damages based on any theory of liability and no matter how caused.

Privacy

Any information that we receive about you while performing the service will be maintained in a confidential manner and will not be disseminated. We do not view any personal, business or other information concerning you except as may be necessary to support the service. Any information we obtain will be only for the purpose of diagnosing and resolving technical or other problems you may be experiencing with the Programs.

Disclaimer of Warranties

You hereby acknowledge and agree that the service is provided by us on an "as is" basis, and access to the service is at your sole risk. We expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to, those of merchantability, satisfactory quality, fitness for a particular purpose, and non-infringement. We make no warranty that the service will meet your requirements or that the service will be uninterrupted, timely or error-free. We also make no warranties as to the results that may be obtained from the use of the service. You agree that any material or data downloaded or otherwise obtained (including plug-ins) through the use of the service is done at your sole risk, and that you will be solely responsible for any damage to its computer system or loss of data that results from the download of such material or data. No information or advice, whether oral or written, obtained by you from us or through the service shall create any additional warranties on our part. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply.

Limitation on Liability. In no event shall we be liable for any indirect, special, consequential or incidental, multiple, punitive or other damages related to the service (including, without limitation, loss of data, loss of income, loss of opportunity, lost profits, costs of recovery or any other damages). This shall be true regardless of how any loss to you may have been caused and without consideration of any theory of liability such as breach of contract or negligence. Even if you have advised us of the possibility of such damages, we shall have no liability under any circumstances. Some jurisdictions do not allow limitation or exclusion of liability for incidental or consequential damages, so some of the above limitations may not apply.

Resolution of Disputes. You and we agree to submit any dispute or claim arising under the Program to binding arbitration. The terms of the arbitration procedures are described in the FirstBank Deposit Account Agreement.
